«Истязание по натуральной правде»: Легитимация насилия и становление рационального политического языка в России XVIII века[406]
4 августа 1762 года Франсуа Пьер Пикте адресовал Вольтеру пространное письмо, в котором не только подробно описал случившийся незадолго до этого в Петербурге переворот, но и задался вопросом: «Имеет ли Нация право распоряжаться престолом?» Можно предполагать, что за этим текстом стояла сама императрица[407]. Вольтер хорошо понял, что от него хотел его женевский знакомый, и уже через три месяца это письмо было анонимно напечатано в «Journal encyclopédique». Среди прочего рассуждая о причинах «революции» в России, Пикте писал:
Soiés sûr, Monsier, que ce n’est point L’Impératrice qui a cherché le trône, qu’en y montant elle n’a fait que céder au voeu général de la Nation, et qu’elle ne s’y est déterminée que pour sauve la Russie des maux aux quels elle sembloit destinée; mais La Nation étoit-elle en droit de disposer du Trône? Cette Question, qui paroitra peut être délicatte, ne me le paroit point de tout. Il est certain que le Gouvernement de cet Empire est Despotique, qu’on n’y connoit ni Loix fondamentales, ni Contract qui lie réciproquement le souverain et le sujet; que les Empereurs ont le Droit de disposer du Trône par ler Testament, et qu’ainsi il semble d’abord que quelque soit le souverain reconnu pour successeur, le Peuple doit lui obéir en silence et respecte ses Volontés, et ses Caprices. Mais s’il existe un Droit naturel, il est obligatoire pour tous les hommes, et indépendant de tout Etablissement humain, et ce Droit, je le demande, s’il oblige le sujet à être fidelle à son Maitre, n’oblige t’il pas aussi le souverain à protéger le sujet et à lui rendre justice; et si le souverain manque à toutes ses Obligations, le sujet ne devient-il pas par Cela même libre des siennes[408].
